These Terms of Service ("Terms") govern your access to and use of Pulse Pilot ("Service"), operated by [ENTITY LEGAL NAME] ("Pulse Pilot", "we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using Pulse Pilot, you agree to comply with and be bound by these Terms. If you do not agree, you may not use the Service. We reserve the right to modify these Terms at any time. Continued use after changes constitutes acceptance.
2. Description of Service
Pulse Pilot is an AI-powered stock trading and market intelligence platform that provides:
- Real-time trading signals generated by machine learning models
- Market news aggregation and sentiment analysis
- Automated and semi-automated trade execution (Premium tier)
- Portfolio analytics and performance tracking
- SEC EDGAR filing analysis (Premium tier)
3. Account Registration
To use the Service, you must create an account with accurate, complete information. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must be at least 18 years old to use the Service.
4. Subscription Tiers
Free Tier: Access to real-time trading signals, news feed, market sentiment data, and basic analytics. No trading capabilities.
Premium Tier: All Free features plus automated/manual trade execution, broker connectivity, ML model analytics, advanced performance metrics, position management, and SEC EDGAR analysis. Billed monthly via Stripe.
Automatic renewal: Premium subscriptions renew automatically at the price and billing interval shown at checkout until you cancel. You may cancel at any timethrough your account's billing portal, and cancellation is as easy as signing up. Cancellation takes effect at the end of the current billing period; you retain Premium access until then. No partial refunds are provided for unused portions of a billing period except where required by law.
5. Investment Disclaimer
Pulse Pilot is a self-directed technology tool and does not provide investment advice. We are not a registered investment adviser, broker-dealer, or financial planner. All trading signals, predictions, and analyses are generated by automated systems, are provided for informational purposes only, and do not constitute financial advice, recommendations, or solicitations to buy or sell securities.
You initiate and authorize every trade. The Service executes only the orders you direct or the automated parameters you yourself configure and enable. You retain full control and sole discretion over your account at all times.
Trading stocks involves substantial risk of loss. Past performance of our models does not guarantee future results. You are solely responsible for your own investment decisions and should consult a licensed financial advisor before making any trades.
6. Automated Trading
If you enable automated trading through the Premium tier:
- You must acknowledge and accept the Risk Disclaimer before enabling auto-trading
- You are solely responsible for all trades executed on your behalf
- You understand that automated systems may malfunction, experience delays, or make errors
- We are not liable for any losses resulting from automated trade execution
- You must configure appropriate safety limits (stop losses, position sizing, daily limits)
- You may disable automated trading at any time via the emergency stop feature
7. Broker Connectivity
Pulse Pilot connects to third-party brokerage services (e.g., Charles Schwab) through their official APIs. We do not store your brokerage credentials. Authentication is handled via OAuth. You authorize Pulse Pilot to execute trades on your behalf when you connect your brokerage account and enable trading.
8. Prohibited Uses
You agree not to:
- Use the Service for market manipulation, wash trading, or any illegal trading activity
- Attempt to reverse-engineer our trading algorithms or ML models
- Share your account or provide access to unauthorized users
- Scrape, crawl, or extract data from the Service beyond normal use
- Interfere with the Service's infrastructure or security
- Use the Service in violation of applicable securities laws
9. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. We collect and process data as described therein. By using the Service, you consent to such processing.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY SIGNAL, PREDICTION, OR ANALYSIS WILL BE ACCURATE OR PROFITABLE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PULSE PILOT AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, TRADING LOSSES, DATA LOSS, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.
Our total liability for any claim arising from the Service shall not exceed the amount you paid us in subscription fees during the twelve (12) months preceding the claim.
12. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control. We are not liable for any losses resulting from service interruptions, including missed trading opportunities or delayed signal delivery.
13. Termination
We may suspend or terminate your account at any time for violation of these Terms or for any reason at our discretion. Upon termination, your right to use the Service ceases immediately. Any open positions or pending trades are your responsibility to manage through your brokerage account directly.
14. Governing Law, Arbitration & Class-Action Waiver
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
Binding arbitration. Any dispute arising out of or relating to these Terms or the Service shall be resolved by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Santa Clara County (San Jose), California, rather than in court, except that either party may bring an individual claim in small claims court.
Class-action waiver. You and Pulse Pilot agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims.
